Divorce Court Mistakes to Avoid

Legal Tips and Resources

If you’re getting a divorce, you will likely have to show up to court several times. If you’re nervous about court, you’re not alone. Going in front of a judge can be a very nerve-wracking experience for many people. However, you can allow your nerves to cause you to make costly mistakes. Here are some common divorce court mistakes you should avoid making.

Being Tardy

The last thing you want to do is tick off the judge before you’ve even had the chance to say a few words. That’s why you want to avoid being last to your court dates at all costs. If you’re tardy, the judge may believe you’re not taking your divorce seriously enough and disrespecting the court’s time. It’s a good idea to leave extra early for court dates, in case there’s heavy traffic or other unforeseen circumstances. If you know that you can’t help being late, you should at least call the courtroom and tell them.

Acting Disrespectful Toward Your Ex

It’s understandable that you may feel anger and resentment toward your ex. However, that doesn’t mean it’s okay to yell and scream and call him or her nasty names in court. If you lose your cool in court, the judge will frown upon that and may make things harder on you. Do your best to stay calm in court and avoid saying something you’ll regret later.

Not Dressing Properly

How you dress during divorce court matters greatly. If you come to court in ripped sweatpants and a dirty t-shirt or very revealing clothing, it may reflect poorly on you. It can even influence the judge’s decision on who should get custody of your kids. To play it safe, always come to divorce court dressed as if you were going to a job interview.

Interrupting the Judge

One of the worst things you can do in divorce court is to interrupt the judge. He or she will see that as incredibly disrespectful. You should always sit quietly and listen as the judge speaks. You’ll have plenty of time to say what you want to say when the judge is finished speaking.

Forgetting Important Paperwork

Before you leave for divorce court, you should make sure you have all the necessary paperwork with you. Whether it’s recent paystubs or medical documentation for your child, it should all be ready for the judge to see.

Not Meeting With Your Divorce Lawyer Beforehand

It’s important to meet with your divorce lawyer before each big court date. He or she will tell you what to expect and everything that you will need to bring. You’ll be more prepared and the process should go a lot smoother.

If you avoid making these common mistakes, you should have a much more pleasant experience in divorce court. If you have further questions about going to court, you should consult with your divorce lawyer in Bloomington, IL.
